Focus: Leading students to understand the role of lawyers in our nation's
history
Time: 50 minutes
LAWYERS IN HISTORY
I. Thomas Jefferson (1743-1826)
A. Practiced law in Virginia.
1. Represented both civil and criminal clients.
B. Third President of the United States (1801-1809)
1. Came in second to John Adams and served a term as Vice-President
under the system then existing..
C. Drafted the Declaration of Independence
"We hold these truths to be self-evident, that all men are created
equal, that they are endowed by their Creator with certain unalienable
Rights, that among these are Life, Liberty and the pursuit of Happiness."
D. As president: Led United States to make Louisiana Purchase from
France.
II. James Madison (1751-1836)
A. Practiced law in Virginia
B. Fourth President of the United States (1809-1817)
C. Leading proponent of the first ten amendments to the Unites States
Constitution, known as the Bill of Rights:
1. Right to free speech
2. Right to worship where you choose
III. Abraham Lincoln (1809-1865)
A. Practiced law in Illinois
B. 16th President of the United States (1861-1865)
C. Led our country through the War Between the States
D. Signed the Emancipation Proclamation freeing the slaves
E. Gettysburg Address:
" . . . that we here highly resolve that these dead shall not have
died in vain--that this nation, under God, shall have a new birth of
freedom--and that, government of the people, by the people, for the
people, shall not perish from the earth."
IV. John Marshall (1755-1835)
A. Practiced law in Virginia
B. Fourth Chief Justice of the U. S. Supreme Court (1801-1835?)
C. Developed concept of federal judicial review: Marbury v. Madison
(1803)
1. That's UNCONSTITUTIONAL!!!
V. John Adams (1735-1826)
A. Second President of the United States (1797-1801)
B. A strong leader in the Second Continental Congress which declared
our independence from England in 1776.
C. Well-regarded for his abilities as a lawyer. Known for his dedication
to individual rights and volunteered contrary to public sentiment in
defending British soldiers after the Boston Massacre (and won the case!)
